Isolo Throne: Court Grants Injunction, Hearing Begins Monday 28th October
Hearing has been fixed for Monday, 28th October 2024 on the legal tussle over the vacant stool of Osolo of Isolo at the Ikeja Division of the Lagos State High Court.
This is sequel to an interim injunction granted by Justice M.A. Savage restraining the defendants from installing Prince Jimmy Adetokunbo Yekini-Goloba as the new king of Isolo Kingdom.
The suit was initiated by Prince Saheed Ishola Aregbesola (a.k.a SA 400).Other applicants in the suit are Chief Taoridi Faronbi (Alado), Chief Rasak Akinsanya Alabe, Alhaji Wasiu Awofe Aregbe Alabe and Mr. Tajudeen Omolade Alabe for themselves and on behalf of Alagbeji Ruling Family of Isolo.
In granting the injunction, Justice Savage relied on a 62-page affidavit in support of the application deposed to by Prince Saheed Ishola Aregbesola and a written address dated on the 26th day of September 2024.
This was brought in pursuant to Order 42 Rule 1 (1) 4 (1) and 8 of the High Court of Lagos State (Civil Procedure) Rules 2019 paragraph 1 of the Pre-emptive Remedies under Practice Direction No 2 of 2019 and under the inherent jurisdiction of the court.Defendants in the suit are the Lagos State Governor, Lagos State Attorney General and Commissioner for Justice, Commissioner for Local Government and Chieftaincy Affairs, Executive Chairman of Oshodi/Isolo LGA, Chairman of Chieftaincy Committee of Oshodi/Isolo LGA, Executive Chairman of Isolo LCDA, Chairman Chieftaincy Committee of Isolo LCDA and Prince Jimmy Adetokunbo Yekini-Goloba.
The latest development is coming on the heels of a refund of N2million to each of the aspirants to the Osolo throne by the Kingmakers.
Keen followers of the impasse had thought the refund would mark the peaceful resolution of the matter but they were wrong with the latest litigation initiated by Prince Saheed Ishola Aregbesola.
However, the Kingmakers remained resolute in their conviction that they made the best choice among the aspirants.
This position was echoed by the Head of the Kingmakers, Dr. Mukaila Adesegun Agbabiaka during a stakeholders strategic meeting with the Executive Chairman of Isolo LCDA, Otunba Adebayo Olasoju at the council secretariat recently.
Dr. Agbabiaka in his address to the gathering which included aspirants, kingmakers, members of Isolo LCDA Chieftaincy Committee and the Area Commander Area D of the Nigerian Police said the kingmakers had chosen Prince Jimmy Adetokunbo Yekini-Goloba as the Oba-elect in accordance with the guidelines of the Chieftaincy Law of Lagos State.According to him, Prince Yekini-Goloba scored a simple majority of two votes to one when the kingmakers casted their votes having met the other criteria listed in the guidelines.
