 Isolo Throne: Court Quashes Order Against Jimmy Goloba 

. Adjourns Hearing of Substantive Suit To Nov. 6 


Justice M.A. Savage of the Ikeja Division of the Lagos State High Court has vacated the interim injunction placed on Prince Jimmy Adetokunbo Yekini-Goloba from being installed as the next king of Isolo Kingdom.

The judge quashed the interim order at the resumed hearing of the application on Monday 28th October after hearing submissions from counsels to both the claimant and the defendants. 

Leading the defence counsel, Prof Olanrewaju Fagbohun (SAN) faulted the claimant for failure to file motion on notice within the stipulated 14 days period. 

The revered legal luminary argued that failure to file the motion within the stipulated period amounts to abuse of court process and should not be encouraged by any judge.

He cited Alexander Marine Management Vs Koda Limited (NWLR) 1999 to argue his position for the injunction to be vacated.


Responding, counsel to the claimant, Y.S. Yusuf aveered that the motion could not be filed within the stipulated period due to technical fault at the court registry, promising to file the motion latest Wednesday 30th October 2024.

He, therefore, pleaded with the court to rather extend the interim order till after the motion would have been filed arguing that if the injunction is lifted the defendants are likely to go ahead with the installation which would not be in the interest of his client.

Ruling on the matter, Justice Savage posited that failure to file the motion is indeed an abuse of court process aveering that the claimant had more than enough time to do so since 26th of September when the interim order was granted.

He therefore vacated the order and adjourned the case till 6th November 2025 for hearing of the substantive suit.


It would be recalled Justice Savage had on 26th September 2024 granted the interim order restraining the Lagos State Governor, the Attorney General and Commissioner for Justice, the Commissioner for Local Government and Chieftaincy Affairs, Executive Chairman of Oshodi/Isolo LGA, Chieftaincy Committee of Oshodi/Isolo LGA, the Executive Chairman of Isolo LCDA and the Chieftaincy Committee of Isolo LCDA from installing Prince Jimmy Adetokunbo Yekini-Goloba as the new king of Isolo Kingdom.

The suit was initiated by Prince Saheed Ishola Aregbesola (a.k.a SA 400).Other applicants in the suit are Chief Taoridi Faronbi (Alado), Chief Rasak Akinsanya Alabe, Alhaji Wasiu Awofe Aregbe Alabe and Mr. Tajudeen Omolade Alabe for themselves and on behalf of Alagbeji Ruling Family of Isolo.
